PEARSON FRONTER e1 USER TERMS AND CONDITIONS
Pearson Fronter e1 is owned and operated by Pearson Education Limited ("us"). By using Pearson Fronter e1 you accept the terms of these User Terms and Conditions. If you do not agree to the provisions of these User Terms and Conditions, please do not use Pearson Fronter e1. Your school's and L(E)A's use of Pearson Fronter e1 is governed by a separate licence agreement ("School Agreement") which applies alongside these User Terms and Conditions.
Right to use Pearson Fronter e1
You are permitted to access Pearson Fronter e1 on computers only through password access.
Your use of any content held on Pearson Fronter e1 should be in accordance with any rules or guidelines determined by your school or L(E)A.
Please note that your use of Pearson Fronter e1 may be monitored for system performance, to ensure compliance with these terms and conditions and as otherwise reasonably required to operate Pearson Fronter e1 and for anonymised research.
You may not:
- use, reproduce, deal with, modify, adapt, reverse engineer, decompile or disassemble the whole or any part of Pearson Fronter e1, except as permitted by these User Terms and Conditions;
- download the whole or any part of the content held on Pearson Fronter e1 for distribution to anyone outside of your school other than as permitted by your school/L(E)A;
- remove any copyright, trademark or other notices on Pearson Fronter e1;
- use Pearson Fronter e1 to transmit any chain letters, spam or junk email;
- interfere with or disrupt Pearson Fronter e1 or any servers or networks connected to it; or
- disclose your password to anyone or permit anyone else to use your password. You are responsible for any use of your password.

Content may be supplied by you, pupils, parents of pupils, your school or L(E)A, or other schools and third party users of Pearson Fronter e1. We have no control over such content and cannot guarantee the accuracy, integrity or quality of any content on Pearson Fronter e1 and will not be responsible for the content. In certain areas of Pearson Fronter e1 you may be permitted to submit pupil or other personal data, learning materials, or other content. We reserve the right, but we have no obligation, to monitor materials posted in any area of Pearson Fronter e1. We also have the right, but no obligation, to remove any material that might be in breach of these User Terms and Conditions or any applicable law.
By submitting any content you agree to abide by the following rules.
You may not submit any material which:
- advertises or promotes any goods or services;
- reveals any confidential or sensitive information (unless you have been given permission to hold such information on Pearson Fronter e1);
- contains or links to any unlawful, threatening, harassing, abusive, libellous, offensive, indecent, obscene or adult material;
- contains any material which you do not have permission to use (including material which may be protected by copyright, trade marks, database right or any other form of intellectual property right);
- contains viruses or any other components with harmful or contaminating effects on Pearson Fronter e1 or any equipment connected to it;
- implies that any statements you make are endorsed by us or which is otherwise misleading, inaccurate or untrue; or
- impersonates any living person.
Pearson Fronter e1 may also contain content submitted by other schools over which we have no control. We cannot guarantee the accuracy, integrity or quality of content submitted by them.
Plug-ins and Linking
Pearson Fronter e1 may make some software (owned by other parties) availablefor download in order to allow you to view content ("Plug-ins"). Your use of Plug-ins is governed by the terms of any licence agreement that may accompany or be included with those Plug-ins.
In certain areas of Pearson Fronter e1 there may be links to web sites owned by other entities. Content on the Internet changes minute by minute, so we cannot guarantee the content of or the availability, integrity or quality of these websites. You acknowledge that we will not be responsible for them.
We do not monitor and cannot guarantee the content, availability, integrity or quality of websites which other users may include in content they submit to Pearson Fronter e1 and you acknowledge that we will not be responsible for them.
Limited Warranty and Limitation on Liability
We make no warranty that Pearson Fronter e1 is free from viruses or anything else that has contaminating or destructive properties. We exclude all express or implied warranties or representations to the fullest extent permitted by applicable law, including without limitation, any warranties or representations as to satisfactory quality or fitness for purpose.
If you have any claim (for breach of contract, negligence or otherwise) in respect of your use of Pearson Fronter e1, then this claim should be addressed through your school. You should be aware that any and all claims against us by you (an individual user) under these User Terms and Conditions, will be limited to the amount of £50 in total, it being acknowledged that you as an individual user will not have paid us any sums in respect of your use of or access to the Application.
To the maximum extent permitted by law, we will not be liable for any indirect or consequential loss or damage (including loss of data or lost income or any damage suffered in reliance on the data held on Pearson Fronter e1) as a result of your use of Pearson Fronter e1. In the case of death or personal injury caused by our negligence, however, our liability will not be limited. Nor do we exclude liability for fraudulent misrepresentation.
You agree that you are responsible for all material you submit to Pearson Fronter e1 and will be responsible for all claims, costs and expenses (including reasonable legal expenses) that we incur if you breach these User Terms and Conditions or any applicable law.
We reserve the right to make changes to these terms. We will make it clear when any such changes are made, but would suggest that you check these terms on a regular basis so that you are aware of these changes. These changes will not affect the terms of the separate licence agreement which your school/L(E)A has entered into with us.
The Pearson Fronter e1 logo and the Pearson Fronter e1 name are trade marks of Pearson Education Limited and you may not use them or any other third party trademarks contained on Pearson Fronter e1 without our prior written permission.
These User Terms and Conditions are governed by English law. In the event of any dispute regarding these User Terms and Conditions or any matter related to Pearson Fronter e1 you agree to submit to the exclusive jurisdiction of the English Courts.
Our failure or delay to exercise any right or remedy under these User Terms and Conditions does not constitute a waiver of that right or remedy.
These User Terms and Conditions contain the entire agreement between us regarding Pearson Fronter e1. Your school's/L(E)A's use of Pearson Fronter e1 is governed by a separate licence agreement which you are also obliged to comply with. Your non-compliance with these User Terms and Conditions may result in our suspension or termination of your school's/L(E)A's access to Pearson Fronter e1.
If any part of any provision of these User Terms and Conditions is held invalid, the remaining parts of the provision and all other provisions shall continue in effect to the fullest extent permitted by applicable law.
A person who is not party to these User Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these User Terms and Conditions. This shall not affect any right or remedy of a third party which exists or is available apart from that Act.
We will not be responsible for any breach of these User Terms and Conditions caused by circumstances beyond our reasonable control.
We may immediately suspend or terminate your access to Pearson Fronter e1 without notice if any breach of these User Terms and Conditions by you is brought to our attention or in the event of breach or termination of your School Agreement.
